This Privacy Policy applies to information ZenMix processes for its own business purposes. When ZenMix processes information solely on behalf of a business customer in providing services, that customer's instructions, applicable agreements, and applicable law may govern that processing.

1. Information We May Collect

When necessary to provide requested services, we may receive or process information relating to:

We may collect information relating to quotes, orders, invoices, purchases, payments, subscriptions, refunds, taxes, and transaction history.

Payment-card and other payment information may be processed by third-party payment processors. ZenMix may receive transaction information from those providers without receiving or retaining complete payment-card credentials.

Such information may include business records, user information, email information, files, configuration information, logs, account information, technical information, or other data accessible through systems on which ZenMix is authorized to perform services.

ZenMix does not necessarily determine the nature of all information stored within customer-controlled systems. Customers are responsible for informing ZenMix of special legal, regulatory, contractual, privacy, security, retention, or handling requirements before providing ZenMix with access to information subject to those requirements.

The customer generally determines the purposes for which its information is processed and is responsible for:

Where a privacy request concerns information controlled by a ZenMix customer, we may direct the requesting individual to that customer or assist the customer as required by applicable law or agreement.

5. Disclosure of Information

ZenMix may disclose information when reasonably necessary for the purposes described in this Privacy Policy.

This may include disclosure to:

These parties may process information under their own terms and privacy practices or as service providers to ZenMix, depending upon the relationship and service involved.

6. Business Transactions

Any such processing remains subject to applicable law and applicable privacy commitments.

7. Legal, Security, and Protective Disclosures

ZenMix may preserve, use, or disclose information when we reasonably believe doing so is necessary or appropriate to:

8. Sale and Use of Personal Information

ZenMix does not sell personal information for money as part of its ordinary business operations.

ZenMix may disclose information to service providers, vendors, contractors, business partners, or other parties as described in this Privacy Policy and as reasonably necessary to operate our business and provide requested services.

Where applicable law defines terms such as "sale," "sharing," or "targeted advertising" more broadly than an exchange of information for money, ZenMix will address applicable obligations as required by law.

9. Marketing Communications

Where permitted by law, ZenMix may use business contact information to communicate about ZenMix products, services, updates, offers, or other business information.

You may opt out of promotional email communications using the unsubscribe method provided in the communication or by contacting us.

Opting out of marketing communications does not prevent ZenMix from sending transactional, account, billing, security, support, legal, or other non-promotional communications.

10. SMS and Mobile Information

If you communicate with ZenMix by SMS or consent to receive text messages, we may use your telephone number and related information to provide customer care, respond to inquiries, and send service-related communications.

Message frequency varies. Message and data rates may apply. Where applicable, reply STOP to opt out and HELP for assistance.

Mobile information, including telephone numbers and SMS consent information, will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.

11. Cookies and Similar Technologies

Our website or the technologies used to operate it may use cookies, log files, or similar technologies for functions such as security, website operation, preferences, diagnostics, performance measurement, and analytics.

The technologies actually used may change as our website and service providers change.

You may be able to control certain cookies through your browser or device settings. Disabling cookies may affect some website functionality.

12. Third-Party Websites and Services

Our website, communications, or services may contain links to or integrate with third-party websites, applications, products, or services.

ZenMix does not control the privacy, security, or data-handling practices of independent third parties. Their practices are governed by their own terms, privacy policies, and applicable law.

We encourage users to review the applicable third-party privacy policies before providing information directly to those parties.

13. Data Security

ZenMix uses administrative, technical, and physical safeguards that we consider reasonable and appropriate in light of the nature of the information, the services involved, and reasonably foreseeable risks.

However, no method of storage, transmission, processing, authentication, networking, or security is completely secure. Accordingly, ZenMix cannot guarantee that information will never be lost, altered, accessed, intercepted, disclosed, or compromised.

Customers remain responsible for maintaining appropriate security within their own environments except to the extent a specific security responsibility is expressly assigned to ZenMix in a written agreement.

14. Security Incidents

If ZenMix discovers a security incident involving information for which applicable law or a controlling agreement imposes notification or cooperation obligations upon ZenMix, ZenMix will address those obligations in accordance with applicable requirements.

Where ZenMix maintains or processes information on behalf of a customer, ZenMix may notify and cooperate with the applicable customer concerning an incident as required by applicable law or agreement.

Nothing in this Privacy Policy is intended to waive, eliminate, or modify a security-incident obligation that cannot lawfully be waived or modified.

15. Data Retention

ZenMix may retain information for as long as reasonably necessary for the purposes for which it was collected or processed, including to:

Retention periods may vary depending on the type of information, applicable services, contractual requirements, legal obligations, operational needs, backup cycles, and legitimate business requirements.

Information may remain temporarily in backups, archives, logs, or systems until deletion or overwriting occurs through normal retention processes.

16. Data Deletion and Account Termination

Termination of services does not necessarily result in immediate deletion of all information.

ZenMix may retain information following termination when reasonably necessary for legitimate business purposes, legal compliance, billing, dispute resolution, fraud prevention, security, enforcement of agreements, or the establishment, exercise, or defense of legal claims.

Customer-controlled information may also remain with independent third-party providers according to their respective retention practices and agreements.

17. Privacy Rights and Requests

Depending on your location, the type of information involved, our relationship with you, and applicable law, you may have certain rights concerning personal information.

Where required by applicable law, these may include rights to request access, correction, deletion, or other treatment of qualifying personal information. Such rights may be subject to legal exceptions, identity verification, record-retention obligations, security requirements, and other limitations.

ZenMix may request information reasonably necessary to verify the identity and authority of a person making a request before responding.

If the information is controlled by a ZenMix business customer rather than ZenMix, the request may need to be directed to that customer.

Requests may be submitted using the contact information below.

18. Information About Children

ZenMix's website and general business services are not directed to children under 13, and ZenMix does not knowingly solicit personal information directly from children under 13 through its general website.

If we learn that personal information was collected directly from a child in a manner requiring parental consent under applicable law and such consent was not obtained, we will take appropriate action as required by law.

This section does not prohibit ZenMix from processing information contained within customer-controlled systems when providing authorized services to a business, school, parent, organization, or other customer.

19. Information From Outside the United States

ZenMix is based in the United States. If you provide information to ZenMix from outside the United States, information may be processed or stored in the United States or other locations in which ZenMix or its service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from the laws where you reside.

Where applicable law imposes specific international data-transfer requirements, those requirements will be addressed as applicable to the relevant processing relationship.

20. Regulatory and Sensitive Information

Unless ZenMix expressly agrees otherwise in writing, customers should not assume that an ordinary ZenMix service is specifically designed to satisfy specialized regulatory requirements applicable to health information, financial information, education records, government-controlled information, payment-card information, export-controlled information, or other specially regulated or restricted data.

Customers are responsible for notifying ZenMix before providing access to such information when specialized contractual, technical, regulatory, security, or privacy requirements may apply.

ZenMix's access to regulated information while providing technology services does not by itself constitute an agreement by ZenMix to assume a customer's regulatory role or compliance obligations.

21. Changes to This Privacy Policy

ZenMix may update this Privacy Policy to reflect changes in our business, services, technology, legal requirements, or information practices.

The "Last Updated" date above identifies the current version.

Changes will apply prospectively as appropriate. Where applicable law requires additional notice, consent, or other action for a material change in how previously collected personal information is used, ZenMix will address those requirements as applicable.

22. Relationship to Other Agreements

This Privacy Policy is intended to provide general information about ZenMix's privacy practices.

A customer agreement, data processing agreement, business associate agreement, statement of work, vendor agreement, or other written agreement may contain more specific privacy or security provisions.

Where a controlling written agreement establishes different or more specific requirements for particular information or services, that agreement will govern the applicable relationship to the extent of the conflict.
